The Honorable Senator Barbara Boxer
Dear Senator Boxer: As the wife of a Mesothelioma patient, I feel strongly that it is extremely important that the above bill be defeated when it is brought to the Senate floor. Please read the following explanations and attached documentation. My husband, George, was a very healthy, energetic and outgoing person his whole life. Last year when he was finally diagnosed with Mesothelioma, we were given the worst possible outcome; he was told he had approximately 4 months to live. Please see the attached information regarding George's biography. His work habits have always been excellent. He gave over 100 percent every day, and felt safe in his work areas. He had no idea that he was being poisoned with asbestos and that the companies that sold the products he was working with containing asbestos did know. There is no financial restitution that can give George back his life. As a wife, I will not have a future to look forward to with my husband; and, our daughters and grandchildren will not have their wonderful mentor and emotional supporter. There are probably many frivolous lawsuits that get filed in court. As the wife of a man suffering from malignant Mesothelioma, a cancer caused by asbestos, a cancer that the asbestos manufacturers knew about more than 60 years ago, a cancer that does not have a cure, a cancer that causes much pain and suffering, a cancer that was totally avoidable and preventable had the companies been decent and honest -- I can tell you there is nothing frivolous about our lawsuit filed in Los Angeles. When a Mesothelioma patient contracts this disease, he/she should be able to sue the offending companies that turned their heads and ignored the severe warnings about asbestos and have their individual day in court. SB 1125 would group all patients together, ignoring the severity of some and the life expectancy of others. There are so many other points to this Bill that are just plain wrong, immoral, un-American and unconstitutional, we ask that you defeat SB 1125 outright. Thank you for taking the time to help us and listen to the voices of the innocent victims. Yours truly,
Ruth Lachapelle and Family
